Hi all,

Some expert help/advice needed please. About a year ago I was being threatened by GE Money regarding an outstanding £3,000 debt from a Debenhams store card. Stupid I know!

I provided them with evidence of my income and expenditure and demonstrated that £50.00 per month was as much as I could afford to repay. Unfortunately this was not deemed sufficient and the matter ended up going legal and resulting in giving me a County Court Judgement and having to repay an amount of......£50.00 per month!

Now I know I was silly for getting into debt with the storecard in the first place but I am still somewhat aggrieved to have received a CCJ when I clearly stated that £50.00 was all I could afford and this is subsequently what the Court has set as a repayment figure.

Can I complain to someone about GE Money and their actions and unwillingness to cooperate? Is there anything I can do to quash the CCJ?

    Are you paying the £50 every month on time. have you been doing that since the court order. have you ever missed or been late with the £50.
    There will be no Brexit dividend for Britain.

    Sorry but they had every right to go through court and get a CCJ issued. You failed to pay the agreed amounts and so broke the terms and conditions. They tried to get you to repay, you couldn't and a judge issued a CCJ. This is for a creditor to protect their money - you then can't or won't pay the CCJ th next step is bailif, then potentially attachment of earnings or charging order on your house if you own your own property... It's nothing more than a step in the debt recovery process I'm afraid.

    gfplux - Yes paid on time each month no problems.

    MrsTine - Understand what you say, and yes I did not stick to the original agreement, which I regret now, but when we (myself and GE Money) were trying to come to some agreement they asked for a breakdown of my income and outgoings to confirm that £50.00 was all I could afford. So why did it have to go legal?

    Because it is their right to...
    The only way to overturn a CCJ is if you settled the debt before the judgement, paid it in 28 days of judgement, they failed to send the paperwork to the correct address or you were not told about the judgement being made.
    They didn't have to go legal but they did have every legal right to I'm afraid... One common reason is that IF you end up struggling even more then in a DMP forexample a CCJ would be considered a "priority" debt over any other unsecured debt... They're only protecting themselves...

    Ok, thanks for the advice, seems that I'm in the wrong on this one. Just somewhat annoying that my offer to them was exactly what the judge set as the repayment figure.......with a CCJ slapped on for good measure!

    You are lucky the court set the repayments at £50 per month. I had a GE Card which they then sent onto Links Financial who issued me with a CCj, I offered to pay £40 on a balance of abt £1800 which was the max I could afford, Link in their wisdom decided not to accept my offer so the court have set it at £168.00 per month. Don't know where or how they got to that figure considering all I have left after paying everything is about £10 per month. The 2nd payment is due soon ( I had to borrow it frm a family member last month) so don't know what I'm going to do!

    BorassicLint - Sorry to hear that, sounds ridiculous, where did they come up with that figure? Hope you find a solution soon, perhaps someone on here can advise/help.
