I did`nt declare the car off road (sorn). Help !

    Really, you should have notified DVLA that the car ownership had changed to the finance company, but equally they should have advised if they had sold it on or just parked it up.

    Thanks for the reply. I have already done what you have suggested, but the Mags court still keep banging on about me pleading guilty & wanting their £260.00.

    You have filled out a stat dec stating that you never received any information from DVLA about being taken to court. So you couldent defend yourself.

    Therefore the ruling in the Mags court isnt correct. They should basacially set a new date for you to go to court where you can then produce the evidence stating that you were not the registered owner of the car.

    Get onto the finance company and ask them for all information they hold on you under DPA and any proof of when the car was returned. Get onto the DVLA and ask when they issued the SORN infringement. Then you can prove that the car had been repoed.

    Please can I suggest that you seek advice from CAB or another organisation like that. I can only say what I think and this might not be true.

    I have been taken to court without knowing it and issued a £700 fine, filled out stat dec and accompaning information under oath havent heard anything since.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    Is it the court or a balliff seeking the money?

    If balliff see "If you were unaware of the fine being issued or correspondence had gone to a previous address, then the ONLY way to get this debt away from the bailiff and returned to the court is by way of a Statutory Declaration.

    This will need to be sworn in front of a solicitor and this should cost just £5. The Statutory Declaration must then be either faxed to the Magistrates Court where the fine originated from or taken there in person.

    The bailiff MUST then withdraw all enforcement.

    The following is a template Statutory Declaration."

    So after this you can have your day in court!!!!

    Thank you so much for all your help & support.

    Today I managed to speak to a legal adviser at DVLA, & I explained the situation to her, she was very symathetic & told me to put everything in writing to her including all the correspondance with the Mags Court.

    All in all, she said basically that case will be closed. So heres hoping that it will be an end to this nonesense.
