no notice to redundancy, company gone into liquidation but some staff kept

My oh has been made redundant today, he went into work as normal having no clue that they would tell him after working this morning that he was no longer needed, along with 7 other people.

He has some forms to fill in (RP1) which i think are for statutory redundancy pay, but apart from that he has been left high and dry by the company, should he have been given notice or something?

Any help or info would be great as we are both clueless about this situation and quite worried.

    This happened to me on Friday.

    Some people will have been kept as the administrators will see a part of the business can be sold on as a going concern, or they will want skeleton staff to work to wrap up areas of the business which cannot be shut down instantly.

    The RP1 form which has been given to him can be used to claim for any outstanding pay, any holiday pay which is due, any redundancy money which may be payable (but he has to have worked there for two years) and also for compensation as he didnt receive any notice.

    Other than that, Im afraid its a case of signing on and claiming benefits as quickly as possible, to tide you over until he can get another job.

    The money which can be claimed back from the government is capped and I would recommend that he gets it filled in and returned as soon as possible, as its likely to take 4-6 weeks to even get your first response..... god knows how long to acutally get any money.

    He should have been given contact details for the appointed administrator and he should keep in touch with them. they can help with the form-filling etc x

    Thanks for the replies, will he still be able to sign on whilst looking for another job even though i work 30 hours a week?

    We have a daughter and although we have a little saved this won't cover months of being out of work if nothing turns up.

    We lost our business shortly after Christmas we and the staff filled in Redundancy forms and all other staff were paid by my husband before the company folded with our savings. The staff had had all there accrued holiday but were still owed redundancy. We all received letters back stating no-one was entitled to nothing as another Company took staff on. But my husband & me did not get any holiday pay at all or pay for at least 12 weeks. Is this right?

    It would depend on how much you earn more so than the hours you do. Its still worth your OH sigining on as if he isnt entitled to benefits he will stil get National Insurance credits towards his pension.

    If he is entitled to benefits then you might also qualify for Council Tax benefit...
