FOS what a joke

    the offer letter from the Haliax says "that in review of your current financial circumstances to help you, I would to offer you a payment of £105.00 which amounts the the fees debited to your account between 14th April 2009 and 22nd April 2009"
    The FOS letter says that "in their view, by making this offer, the bank has fulfilled its obligation under the Banking Code"

    We have just gone through all the paper work, and discovered in any of the Halifax letters have they mentioned, about 3 months period without bank charges.

    Also on the Halifax acceptance form, its says "In Settlement Of My/Our unarranged overdraft bank fees complaint"
  • What happened between those two dates with your circumstances?

    EDIT: It would only be for the financial hardship element of the complaint since they are unable to make full and final settlements of bank charges cases.

    Our circumstances got worse, bailifs came to the door, car was towed and crushed and the money of my JSA was gone,obviously from 3 charges, and if it hadn't of been of my partners parents (who are both pensioners) my family would have not eaten!

    Ok this is what we have got to do.

    When did the hardship begin:
    "a.
    evidence of changes in lifestyle, including loss of employment; disability; serious illness; imprisonment; relationship breakdown; death of a partner; starting a lower paid job; parental/carer leave; and starting full-time education;"

    And how did the above impact on your ability to pay priority debt arrears.
    Did you send them arrears letters? We kinda have to exclude payment plans but we are looking at water bill, gas and electric.
    Was the car taken in the end?(cos that kinda takes the HP out of the Priority debt arrears).
    The charges from when the hardship started is where you have to measure it and the other thing is how will Halifax not charging you for 3 months help you to manage the bills?

    Thankyou so much for the help you have given me and my family, do we now have to go back to the FOS with all this information or back to the Halifax and start again.
    The car was owned outright and not on HP.

    You have to argue that the charges once you were in hardship made the hardship worse and that while £105.00 plus 3 months without charges and interest will help(let's be honest if they said £0.00 then it would have been worse) that x happened and y occurred. Remember, the amount you may get might not be 100% of the total charges taken BUT it might be 50% which will help with the priority debt arrears, ok?

    It is the approach I would use and it may not work but hopefully if it does then at least you can see over the top of a difficult time. I would redo the Income and expenditure list as well so you can see if anything has changed today.

    It may be a little more precise than the one the bank may have provided.
    Good Luck but if they say £105 and three months suspension, at least we have tried and at least got a fairly good fall back.
