Dispute over Capital one charges, though account with Collection Agency - Help

Hi,
I have just found this web site over the past couple of days, and well, all I can say is a big thank you to everyone for all the helpfull advice.
Anyway, long story, here goes..
Due to loss of employment, I could not pay the minimum payment of £80 to capital one since February. Despite me sending many letters asking them to accept a token payment of £10 a month, and to stop charges, a £1200 bill jumped to £1900. A couple of months ago, my Capital One credit card was passed over to Fredricksons debt collection agency. At the time I agreed to pay £50 a month to them, as I do want to get it cleared. I made the first payment on the 30th of June. This month, my husband has had some time off sick, therefore i am unable to pay £50. i was going to write to them offering £20, but having read this thread, have i shot myslef in the foot by agreeing to pay £50. Can i still claim for the excess charges against capital one, in that case, what would i do about future payments to fredericksons?

You need to request statements from Capital one and you can claim all the charges back from them which may significantly reduce the debt. If you are going down this route then tell Friedrickson that the debt is now in dispute since the amount you owe includes unlawful charges to the account.0

Send letter to Capital One requesting Statements which will cost you £10 and send one to Fredricksons telling them that you are querying the amount of the debt with Capital One directly and once you have clarified the amount you will make a payment plan to clear the rest.
DO not agree to anything until you have the details. A Debt Collection Agency cannot do anything to you until the disputed amount is resolved. If they threaten court let them do that but remind them you are disputing it.0 -
Hi,
Well, I had a phone call from Frederickson’s today. Was told very sternly that I must pay. When I told them that I was in dispute over the charges that have been added to my account, I was told not to bother as I wouldn't get anything anyway. When I told them that part of my enquiry was regarding payment protection, which was mis-sold as I wasn’t working when I first applied for the card, the person at the other end went all quiet and told me to keep in touch with them with progress.
All I could think of was the success stories that I have read about on here. Thank you everyone, especially Natweststaffmember who gave me confidence to argue my point.
I will keep you all updated
