plasma tv 2 weeks out of warranty

bought a samsung plasma tv july 08 for £599. two weeks after guarantee ran out it developed damaged pixels rang up comets and an engineer came out and said that the whole screen panel needs replacing. i mentioned the soga 1979 they are only willing to repair this free of charge and not give me a replacement . i will have to buy another tv while its getting repaired. they told me that it could take up to a month to fix it. should i accept their offer or push them to replace tv as its not fit for purpose. is a month acceptable or can i argue the case that buying another tv is putting stress on my finances. comet will not budge on this matter , all they are saying i should be lucky they are not charging me for this i am fuming. by the way the engineer said it will cost £500 for the panel as its the major part of the tv.

Are you saying you only have one tv in the house??
Seriously if you don't have to buy another tv, join freecycle and ask politely for a small portable tv explaining why you need it. If you get something over 20inches it's likely not to work and most people won't allow you in their homes for you to check it works.
You will have to collect it but it's much cheaper than buying one.
BTW comet and such companies alway talk sh*t about your legal consumer rights. However they are right that they don't have to loan you a replacement under the law.I'm not cynical I'm realistic

This is how the SOGA works - (I've discussed it with lawyers including one who worked for the OFT)
1. If the vendor can repair the item then they should repair it. TVs can be repaired.
2. You may get a new item if it is not feasible for the vendor to get the item repaired. As TV's can be repaired then you don't get a new one.
3. If the item can't be repaired and the item is not stocked any more then you are entitled to a refund.
However the amount you get refunded depends on what the item is and how long you have had it plus the retailer. So if you had the TV less then a month you are likely to get a full refund after that you will likely get partial refunds.
Again your TV is getting repaired so this is not applicable.
There are other issues but as you are getting your TV repaired you are getting all you are entitled to by law.I'm not cynical I'm realistic

I agree with other posters that they are within their rights to attempt a repair first, but...You are lucky they are repairing it without a fight, you are not entitled to a refund or loan set.

Under the SOGA they must attempt a repair within reasonable time, at no additional cost to you and without causing any significant inconvenience.0 -

Dosent matter what the SOGA says, its out of warranty in Comets eyes, so the OP is lucky they dont have to get a report done to prove its a inherent fault.0 -
thanks for all replys. at the end of the day i would expect at tv to last at least 3 years before being faulty. technology has advanced so much. i had a 32 inch crt tv for 7 years before it packed in, i never had a problem with it.this was my first plasma tv and it will be my last if i could help it but they have stopped selling crt tvs so i have no option . i should have gone to john lewis for the tv as they do a free 5 year guarantee when buying a tv off them, i wonder if they are setting an example to other retailers who try and sell you extended guaranty for 3 years at a cost of £159 !!!
they are coming today to collect the tv, but i'm not confident we will wait and see.0 -

I agree with that, if I was him I would gladly pay to have one done by an independent repairer. You never know, they might even be able to fix it quicker at Comet's expense!0 -
