contract with '3'

Hi

My boyfriend has been with three for four years.
his contract is running out in september.
so he upgraded and got nokia n97 after 3 days the phone has been stolen.
he went to police station to report it called three to block his phone and he's sim card.

He called them today to request his new sim card again as he didnt get it and tell them that he want to leave three once he's contract is going to end in sept. they told him because u got this phone he autmatically got contract for another 18months..

they only way to cancel is to call within 14 days (he call after 4days) send them this phone back,but how he supposed to do that if phone got stolen got report from police, '3'blocked it and phone is now useless whoever is got it.

Is there anything you can do? is it the reason to sue them?
Is bad enough he lost a brand new phone and now they put pressure on him to keep contract for another 18months with no phone even though they know the situation he's in.

The worst thing is that he's off work for sometime but they simply dont care.

    So you expect them to write the contract off because the fone was stolen?claim on your house insurance.

    They are correct, they only way to cancel is to send the phone back inside 14 days. Having the phone stolen isn't a reason for them to end your contract, sorry.
    They'll issue you with a new sim and you can put that in a compatible handset and carry on with that.
    You have no grounds to sue them I'm afraid.

    Why on earth would you think you could sue?

    I don't wish to sound judgmental, but if I was 'off work for some time' which is making it harder financially there is no way I would have just upgraded to a top of the range handset at a minimum of £35/month for 18 months.

    if mobile phone companies cancelled contracts whenever somebody said they lost their phone, how often do you think people would claim to have lost their phone whenever they wanted to leave their contract early?

    You don't rent the phone, you are given it in return for agreeing to a contract. If you lose it then it is your problem nothing to do with 3. That is why some people pay for mobile phone insurance to guard against this.

    I am afraid he will have to wait out his 18 month contract or pay for the whole 18 month period.

    Yeah except that this phone was for free and cost £25 a month,on the phone the lady didn't mention upgrading for 18months but 3 and yes you sounded judgmental.

    The phone wasn't free, you pay for it over the 18 month period of the extended contract. 3 (or any other mobile company) do not simply "give away" £600 pieces of equipment because they feel charitable. As it was an early upgrade, you're actually tied in for 20 months by my calculations. :(

    well any phone they give away with contract is never for free cause you will paid them for 18months more than that,i know:-) he made a mistake unfortunate that the phone got stolen in such a short period of getting at the first place.anyway thanks for opinions!
