Faded capped yellow lines with a blue badge

Hi every one,
Can some one help me please.
I parked on a double yellow line with 2 yellows on the kerb but the yellow on the kerbs was so faded that i could only see one.
Being a blue badge holder i know that i can park there for a certain time,
displaying a blue badge and time clock.
I was wondering if anyone have any templates that i can write to the council disputing this parking ticket about unclear faded yellow lines on the kerb.
on the road they are clear, but not on the kerb.

    No template here but you should get piccies of the faded kerb clips to back up your case. Scan or photograph both sides of the council ticket and host on tinypic. Put the url in this post but leave a gap between http and the rest as you are probably unable to post links yet. Hopefully one of the more expert will be able to pick holes in the pcn and give you extra leverage when you appeal.

    If you only saw one yellow kerb stripe, then you must have known there were loading restrictions at some time, so you should have checked the nearby yellow signs to see exactly what times you are allowed to load (and in your case, park). Had you done so, you would have seen that the real loading restrictions were "at any time". I'm afraid it sounds like you haven't exercised all due diligence before parking, so it's unlikely your appeal will be successful.

    By all means bring the faded markings to the council's attention, but I feel that the above statement of affairs is what they're going to throw at you.

    While I'm all in favour of parking concessions for blue badge holders, such a badge isn't a licence to park just anywhere and you have to consider the obstruction you're causing too. Loading restrictions are made with exactly this in mind.

    Just why should the op have checked to see if the council have made an error in painting and not check whether they have made an error in the pcn and traffic order? Whilst I agree that we should all follow the rules as indicated, the council have a duty to see that all signs, lines and paperwork are as stipulated. There are strict rules that they have to follow and if they do not do so then any pcn could be invalidated.

    Because the former would prevent all the heartache and inconvenience of the latter.
    There are strict rules that they have to follow and if they do not do so then any pcn could be invalidated.
    Maybe so, but up to now we only have one persons opinion of "so faded". Photographs would show any case for further action.

    i don't want people to argue over us or to dispute what i have done wrong.
    it's just that my car was not obstructing any vehicles , we had to take my disabled son to the heart centre as an emergency and all the ambulance was obstructing the entrance, anyway thanx for your help guys , i'll pay the fine instead. many thanx again.

    Don't worry, wer'e not argueing just seeing this from a different perspective. We both have agreed in the end that piccies would have shown if the council are correct in giving you a pcn or not.
    Do I get the impression from your post above that you were at a hospital? Was it a council who gave the ticket or was it on private ground? Even if it was a council ticket there are provisions for emergency cases such as this and you should contact the council before paying.
