Taking the next step if HBOS don't respond

I sent them a letter ages ago requesting the repayment of charges applied to my account while I was unemployed.

They sent me a reply pretty quickly saying they would investigate and reply within 4 weeks.

As the 4 weeks has long since come and gone, I sent another letter to them asking for a positive response within 7 days or I would initiate a claim.

As I'm asking for it to be repaid due to the charges causing financial hardship, can anyone advise on how I should procede should they not reply by tomorrow which is 1 day after the 7 day deadline.

    Did you include and income and expenditure form?
    Did you include copies of priority debt arrears(mortgage/rent council tax, utilities)?
    Did you explain how you had got into financial hardship?
    DId you send it recorded delivery?


    EDIT: if you take them to court the case will be stayed pending the conclusion of the OFT test case issues.
