Ebay Faulty Product

I recently bought a camcorder for £220 on Ebay from a seller with good feedback (99%)(802) since 1993.

The item was paid for on the 20th July
Received on 23rd July

On 25th July I found after first usage that several critical function buttons did not work. Rendering the item useless.

I contacted the seller with:
"The item is faulty. The joystick is non responsive. I will arrange recorded redelivery on Monday. I expect a refund, although I will pay the price of the return postage."

The condition specifies "Used". However it does not specify it's faulty. From the T&Cs point of view has the seller by not declaring the goods faulty mis sold the item?

I am holding off contacting ebay till the seller has responded. Any suggestions?

    so you used it and then it broke, therefore you are at for breaking it, i wouldnt refund you

  • I would wait untill monday or tuesday and if the seller didn't reply i would open a dispute on paypal (item not as described).
    If you do open a dispute at some point paypal will ask you to send the item back (recorded) so you can do that and enter the tracking info on paypal website.

    Are you sure? EBay was not set up before or even on that date according to Wikipedia?

    going through feedback they seem to have a few negs and neuts and even a positive for electrical products but most say were refunded

    so i would leave untill monday/tuesday to give them time to respond to your email then if no responce open up a paypal dispute for item not as described.

    To clarify, I took it out the box attempted to set the date and time following the instructions in the manual. However I was unable due to the joystick being unresponsive. The camera has not left my room, nor has it been used to make any recordings, because I cannot. Everything is still as it was sold.
