Private seller - warranty?

I sold an electronic gadget item some nine months ago on eBay by means of an auction (not BIN). The item was marked as new as it was in its box and gifted to me by someone else.
The item now has a fault on and the user is asking to send it back to me as it has to have a warranty on it.
The item I believe was from the Far East and not a common brand.
What are my rights and responsibilities here?

You have no responsibilities. It was a private sale, and it is a classic case of 'buyer beware'. The buyer has no come back after all this time. I'd just send him a polite e-mail saying 'sorry, but there is no warranty on this item' and leave it at that.I'm a retired employment solicitor. No. That only applies to consumer/business transactions.
A private buyer might have some come back if the private seller misrepresented the facts, and the buyer did not carry out their own inspection before purchase, but even then the buyer would have to act promptly. In that case, for a purchase through e-bay, they'd make an 'item not as described' claim.
But after using the item for several months, it seems clear that the item was as described, but now it isn't working any longer. Sorry but that's just tough.I'm a retired employment solicitor.
