Thank you, Land Registry. You and Eggbox are legendary and have helped so many people with difficulties around charging orders.
I have been in the very complicated position over the last 20 years of being the non-debtor who stayed in the house with a child dependant; divorced from the debtor who has just mentally opted out of anything to do with this as he has nothing to lose and a roof over his head with a new partner.
I managed to sell the house twice but the buyers pulled out when they realised there are restrictions on the property. I couldn't remortgage when my fixed rate deal came to an end so ended up paying massive interest over the years. I have spent countless weeks and months over these years trying to come up with a solution but creditors wouldn't even speak to me as the debt isn't in my name. I have spent over £8,000 on solicitors and have just ended up more confused.
I am now at risk of having the house repossessed which would result in both myself (even though the debts are only in my ex-husband's name) and the creditors losing money - all while nothing changes for the debtor. I have been suicidal more than once over this issue as I have felt so powerless and vulnerable. I am now trying one last time to find a solution where I can salvage as much money for me as possible.
Finding this thread has literally been a lifesaver. Even if I don't get the outcome I want, I feel a little bit more in control and empowered.
