  • Relief... Found a solicitor who really knows what he is talking about!! He explained everything to us before we even asked about the restrictions!!.

    He won't inform creditors until day before the sale, and is used to dealing with concerns from the buyers and their solicitors.

    My creditor, having gained a standard form K restriction, then went behind the judgement and, without appealing against the first Judgement, applied for a variation, requesting a 'modified' CO… which means I now have to give the creditor 14 days notice, pending a transfer! (These 'caution' type of CO were done away with when the new rules came it… but it matters not, apparently).

    This was a 'without notice' application without a hearing, too, so I didn't even find out until after it was granted…neither me or the joint mortgagee, (who is not a debtor) was given any opportunity to argue it.

    Such dirty tricks I'v suffered from these lawyers over the course of the litigation…:(

    But very good luck with this, and do get back and let us all know how you get on!

    Hi… a question for LRR, please;

    If someone sells their property, is it required by law that they inform Land Registry?
    Are there time limits attached?

    Not a lot to report at the moment...all very quiet. Waiting for surveys etc to be conducted so no real activity for the solicitor yet. They have however confirmed how they will play it... pretty much exactly as suggested...tell the creditors about the restrictions only at the last minute.

    They seem to know what they are doing, but it wont be until the buyers solicitors are aware of the restrictions when we will see how good they are.

    I will update as soon as we start to make further progress

    Please can I search for owners of land by title numbers?

    I have paid £6 for out of date information… !

    Isn't everything updated whenever someone adds to their property?

    D45 - you can search by title number using the Detailed Enquiry option in the online service
    Unsure what you mean by 'someone adds to their property'? But assume the title numbers you wish to search are different to the ones shown on the 'wrong information' obtained

    Just that the proprietor had further purchased (in 2005) a large amount of land which does not show on the (ancient) plan details at LR.

    Say, for instance the proprietor of property title EX656144 should purchase further land, EX553257, adjacent to his property, would both pieces of land now be listed under the first title number, or listed under both, or would a new title be needed?

    It's difficult to find an owner of land where the details of ownership have not been registered.

    It would seem that the 2nd title here is still listed as being owned by the vendor, who sold the land in 2005.

    Does that make sense?
