Taking things back to TK Maxx

My wife bought myself and my son two pairs of shorts each. The idea was to see which pair we liked and then take the others back and get a refund, as we were not in store to try them on.

My local TK Maxx exchanged the adult ones but refused to exchanged the child ones as they suggested that they were swimware and they do not exchange swimware. There is a small sign that states this, (not clearly on view), but my wife was not told when she bought the items. If she had have been told she would not have bought 2 pairs.

These items have clearly not been worn. They are as purchased with tags still attached. I would also consider the adult shorts that they have exchanged to be swimware, (have the netting in the lining), which makes the thing more annoying.

Manager was called but was less than helpful.

Any advice please?

    To be honest TK Maxx were under no legal obligation to even refund or exchange the others. I don't think there's anything that can really be done and just put down to one of those lessons. You can make a complaint to them if you want and see if anything happens but they were merely sticking by their own policy.

    The non returnable swimwear (and underwear) is a pretty common policy for clothing stores and your only way around it is if you were returning because of a fault etc.

    You are not entitled to a refund unless the clothing is faulty, a change of mind is not a valid reason to demand a full refund. Most stores will do this out of goodwill but this is over and above consumer law.

    TK Maxx usually make their refund/exchange policy very clear, but unless informed otherwise I would assume statutory rights only, and an exchange on non-faulty goods is not, as far as I am aware, a statutory right.
