Licence returned from Courts but no endorsement recorded

Hi all,
I wonder if anyone can shed any light on the following. I recently got caught speeding (silly me). I was asked to hand in my licence and counterpart at police station which I did. It then went to the Court for endorsement of the points. However, I received it back today and there is nothing recorded in the endorsements column of my counterpart. I called the DVLA and they have it recorded.
So my question is, if I sent a photocopy of my counterpart to an insurance company (for example) and said "look, no points", who would they believe? I thought my licence was supposed to be updated with the points...
Thanks

Hi epiphany66 and welcome to MSE :hello:
What did DVLA say when you contacted them was the reason for returning the licence without the endorsements shown?
As for your insurance, there are 2 things to consider:
1. Does the question on the proposal form say "Do you have a licence with no endorsements recorded on it" or does it as I suspect say something like " Have you ever been convicted of an enforceable offence within the last x years?"
2. Whatever the proposal form asks, remember there is a duty on the insured to disclose all material facts."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
As Premier says you are duty bound to disclose all facts, if you dont you will commit criminal offences and end up in all sorts of problems such as fraud by failing to disclose information (imprisonment up to 12 months)
Prob just an admin error, if you have to send your licence off to the DVLA for anything name/address/renewal etc, they will endorse it instead.0 -
Hi!
thanks guys.
When I phoned the DVLA, they basically said they had been informed of the penalty by the Courts. However, I'm wondering if the Court was supposed to "stamp" the penalty into the endorsements column of my counterpart licence. It was returned blank.
I won't lie to the insurance company, but it just seems strange that I could show my licence and claim 0 points, as the endorsements column is blank.
:rolleyes:0 -
The "courts" .... in reality its an admin clerk in the local ticket office or Criminal Justice unit, handwrite the offence, date, fine and points on. If you send for a new paper counter part i.e. address change this is typed onto the paper counterpart.
Show your licence to who though? Insurnace companies dont ask to see it as they can request all the details electronically, as do police etc. If hiring a car and show licence have to disclose the points or again will have insurnace issues.0 -
i work in the local court, and they should have written or stamped your counterpart in the different columns, stating the date of offence, what offence it was, how many penalty points and if there was a fine. they should then also write the code for their actual courthouse.Helen

A slightly similar thing happened to me recently.
I sent my licence off to be endorsed, received it back with points on it (handwritten). I then needed to add a driving category to my licence so took it to DVLA that same day. Got new licence back few days later but points were not on it (category was).
As I was sitting my minibus test 3 weeks later I decided to wait before doing anything as didn't want to risk missing test for not having licence back.
However in meantime I had letter from DVLA saying that the licence they had sent me was incorrect and I needed to return it for re-issue with points on within 4weeks or it would be revoked.
So once I passed my test and licence was sent off it came back with new category, and the missing points.
It will catch up with you eventually, and you know that DVLA have a record of it. Plus they will have the recording of you enquiring about it! So be honest with insurers etc.
