He could well win such a claim through a County Court, but the problem would be getting the PPC to pay the judgement. Most of them are fly-by-night outfits hiding behind PO Box numbers, with no tangible assets for bailiffs to sieze.... My feeling is that he would be successful if he pursued the case but that ultimately would mean a Small Claims action as they are most unlikely to back down voluntarily.
Does anyone have any advice suggestions or precedents, please?
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years.
