If the contract wasn’t formed when the deposit was left then, as the OP doesn’t want the car once he’d seen it, there is no contract and no basis for retaining the deposit.

sorry for not updaing you, been woking! i did pay on CC and i have now got the deposit back, i explained that the car would never be right in my eyes and they said i can have a full refund, which i was glad and have told them if they do find me another car i am still willing to buy from them0
