payment in lieu of notice

i was recently made redundant and was given 12 weeks lieu of notice to be claimed from the redundancy payments office.

my dilemma is that i want to start my own business before this and i was wondering if i can still claim this money if i am not going to pay myself.

also can i carry on claiming job seekers allowance if i start trading but not paying myself

If it is payment in lieu of notice, employment has terminated but in this case I believe the PILON would be treated as damages for loss of earnings. At the beginning of self-employment, it may well be that you do not earn enough to take drawings in any case - and any of your start-up costs (equipment, advertising, stationery, etc) can be deducted from the amount you receive before working out your profit.

Had you been employed for twelve years or did your contract have a twelve-week notice period for a shorter period of employment?

If you were employed for more than two years, what is happening about your redundancy pay?

    So the company cannot pay?

I think both payments can be claimed and are not subject to any clawback if you start earning.

JSA I think you need to be available and looking for work.

There may be other help you can get if trying to start a business so cannot claim JSA, not that up on benifits/allowances/grants etc.
