Website purchase can't be refunded due to T&C

Hi guys,

I've recently bought something for my brother from an online website, which stated in the T&C, that no refunds would be given once you'd paid for the item.

Now, my brother needed support for the product, so sent an email through to them. Trouble is, they've not replied back even though as part of the purchase/package, priority support was to be given after the purchase, and a reply guaranteed within 12 hours! (It's now been, oh, 7 days) Part of the reason why he decided to go with them was due to their quick replies before the sale - some replies were even given with 2 minutes - so it was assumed that their support would be great.

The website uses 2Checkout.com, which in turn has the option to pay using Paypal (I paid through Paypal)


Is there any way of getting my money back due to false advertisement, or have I no hope?

    Under the distance selling regs he might have been able to reject .... but I think you are only allowed 7 days ... but my attitude would be reject under sales of goods act ... not getting service paid for ....

    Has he tried calling them? Has he checked his spam filter?

    Hi Mark,

    The item is under my name and was paid for by myself. I've checked spam folders and everything, but to date, had nothing. It's funny because we exchanged about 30 emails before the purchase because I had to make sure that the item met the requirements and could do what it said on the package etc.

    I think we will try calling them, but I was hoping it didn't have to come to that - will also keep the sales act in mind as I think that might be the only thing against their word.
