Is a dmp hardship?

Hi all,
I really want to claim my overdraft charges back from Halifax, we are on a dmp - does this count as hardship or is it considered that we are no longer in hardship because all our day to day costs are being met?

I think it is the latter but I still think you should ask the question to Halifax, since they can simply say Yes or NoHi all,

Nothing to lose by trying I guess.
Ironically they would get a 'cut' anyway as they are on our debtors list twice
