landlords failure to return deposit without explanation

    There is no tenancy deposit scheme in Scotland - the Sheriff Court is where you need to pursue it if necessary.

    I would write a letter headed "Letter Before Action" ,confirming the address of the property, the dates of the tenancy, and a brief outline of your attempts to get resolve, as in your posts. Finish the letter by re-iterating that you would like to settle the matter amicably, that you are prepared to give them 3 more working days, but if you have not received a refund of your deposit in full/ full written explanation of any deductions the LL wishes to make ( as applicable) by whatever the date 3 days hence is , then you will pursue the matter via the Sheriff Court without further notice to the LL.

    Your local Council will have a LL Liaison Officer Tenancy Relations Officer who deals solely with private tenancies - it may be worth you speaking to him/her. Is your LL/LA registered with the local Council ,btw, as required under Scottish law? It's a criminal offence not to be.You can check online here
  • Hi Everyone

    First of all thanks to everyone who took the time to read and reply to my thread.

    We had to resort to taking the landlord to the small claims court and at the preliminary hearing the sheriff advised him it would be in his best interest to reach a compromise with us.

    The upshot was we received our full deposit back and the expenses of bringing the court action.

    So although it was a very stressful 7months, it was well worth it.

  • Hooray! Considering some lunatic decided to paint AROUND the curtains, your landlord should have been really ruddy grateful that you returned the property in such good condition. The blighter should have paid you for your services. Cheeky rotten sod!
