Capital One ppi reclaiming - help!!

Hi guys,
Got a letter this morning saying that unfortunately they have been unable to locate the call from when the policy was sold to me and therefore unable to provide information regarding this call.I guess its now time to send them a letter in regards to claiming back my premiums!!

Sorry to hear that, never mind, this happens unfortunately but not to worry.

Received a letter from capital one this morning saying that they weren't going to refund any premiums with a bulk standard letter that they must send to everyone at this stage.Am going to send off the letter again requesting ppi refund reiterating the points and ask that they give there final response to this case.Looks like it could be the Ombudsman next!!

hi just to let you know you are not alone,i requested 11 wks ago for a final response from cap 1 for more or less the same reasons as you and also they could not provide me with the transcripts from so called conversation,stating that they have provided no proof albeit their bog standard letter says that they have,have sent them another letter requesting a final response 2 and half weeks ago reiterating that i would like a final response and so far have heard nixy nowt.my offer was for 300 although i have paid nearly 2000 and have the proof enclosed in the sar.hope you get a response and the outcome you wish for.0

received a letter from capital one this morning explaining that they wouldnt be refunding any premiums due to the fact that apparantly when i phoned to activate the credit card i asked for PPI to be added.I don't believe that i would of done this when i ticked the "NO" to PPI box on the application form.They say i had a chance to cancel within 30 days and i would of had a leaflet through about it but i can't recall seeing anything in regards to this.
Now my question is would it be worth taking this to the FOS as i have been aware for a long time that i was paying PPI but i thought it was just part of the deal with taking the card out in the first place.I feel as though i am jumping on the bandwagon with all the PPi reclaiming that has been going on and to be honest i only looked into this because of all the PPI miss-selling that has been in the news.Do you think that i have a good case even though this has been ongoing for 6 years with me aware of paying the PPI payment even though i didn't request it on my application form.

Was this the final decision?
If not then write back to them to ask them to reconsider with your reasons.
If this was the final decision then yes move on to the FOS.
Did you ever request a SAR (Subject Access Request), this is where they should send everything they hold on you by 40 days, with a charge of £10 postal order or cheque payment.
If you've not done this, it may be useful where anything on PPI should be included within the SAR.

Im in the same boat really. However i have never gone through with it to reclaiming which i now intend to do. They sent me a letter saying the same thing about asking for PPI on the phone. A load of rubbish.
Now, i would probably write one lette back if its not their final responce and state that through their own understanding you signed up on the phone, yet they claim they have no records of the transcripts of phone calls. They have not provided you with any information in the SAR that gives any evidence you signed up for PPI on the phone. Infact all evidance points to you not wanting to sign up.
Ask them how they are certain you have signed up over the phone if (a) they have no transcripts and (b) Nothing is in the SAR that they are obliged to give you under the DP Act. So either they are clearly miss leading you, lying to you or are substantially withholding information they are obliged to give you by law.
If they are certain you signed up over the phone then you want copies of this information as part of your SAR.
Failing to provide this information threaten them with court. State that they will have to provide all these details to the court anyway and even if they do will have to pay cost as it will be seen as wasting the courts time.
It gives you one last throw of the dice and a threat to court might make them think again. After that its the FOS or court. Its your choice.0
