I have just been sent a letter demanding money from Lloyds Tsb via a debt collection company over the bank claims that I am currently in dispute with (put my claim in over 2 years agao). I was wondering if this should be sent to the judge who has stayed the case until the Commercial Court case?

Write back to the DCA stating that the claim is subject to a court claim (quote claim no.) which is stayed subject to the conclusion of the OFT test case and as suchtheir demand contravenes the OFT debt collection guidance and request that the file be returned to Lloyds0

Please can you helpI am 23 years old and have been chasing Abbey National for unfair bank charges on my account for over 18 months. I estimate that I am owed £2500. I have even contacted the Financial Omburdsman. I have all copies of letters, emails and phone calls that I have made to them over the past 18 months.
I recently put in a claim, again, for my unfair charges to be repaid due to financial hardship. Abbey National have now informed me that they have closed my account and passed it on to a debt recovery agency.
Can anybody please help as to what I should do next and whether Abbey National can legally do this?

The FACT is that Debt collectors have ABSOLUTELY NO LEGAL POWER OR AUTHORITY WHATSOEVER!! :rolleyes:
They cant go into your house, they cant touch anything that you own,
they cant do anything at all.
If they/the bank phones you the 1st thing that they do is ask ''can you confirm these details''...,
just say ''i dont know who you are so unless you detail me your name, your date of birth and YOUR home address, then im going to hangup on you''. :cool:;)
if they call back tell them to 'F**K off',
or be even more creative and have some fun with them! :rotfl:
Thers loads of ideas on CAG forums about what you can do like acting like you are deaf and so tehy ahve to repeat everything, keep repeating what they say, using funny accents, agreeing to everything and making it sound like your on their tem but then scream and hangup jsut before tehy ask for the debitcard numbers to pay them! :rotfl::A0 -

Don't agree with your advice because it is irrational and is not reasonable.
Orford is legendary on bank charges sites so I think his advice is the one I would follow.0 -
The banks harassing people and charging people the ridiculously high amounts of charges isnt reasonable or rational either though...

If thats how the game is played why fight it, instead of just joining in and playing it to??

Your tactic is Ignore them/ swear at them/ don't go through security processes with them/ and go to CAG(why not go to PenaltyCharges{Stephen Hone's site}, or Legal Beagles{Curlyben and a host of veterans are there} or ConsumerCreditSupport where Tamadus and Dragonlady are there} or BritishConsumer site{smasher is on that site} or maybe Penaltyactiongroup{Ed. and Tanzarelli are on that site} or maybe even Moneysavingexpert{Martin Lewis' site which we are both on}).
So, Orford said tell them that there is a claim and that the dispute is already in dispute.

I know the CAG thread cos I have, at times, been wetting myself reading it. There are threads on the debt forum here on MSE where some posters have done exactly the same, however, I am very rarely in that area of the forum cos I stick to what I am good at, bank charges reclaiming.Because the end monietary result will be exactly the same.

Yes and all those charges are reclaimable and could be a hardship case.

But you gotta remember, on this specific user we are getting the DCA out of the picture or if they want to remain then we are getting them to take the OP to court cos bank charges is easily defendable.
It's not a CCA related thread or loan agreement one
