Received Claim Form (MoneyClaim.gov) for old Credit Card

Hi all,

After some advice. When I got home yesterday there was a claim form from Northampton County Court for Lowell Portfolio Ltd. The details of the claim are for £3400 (£85 court fee) for Egg Banking PLC, a credit card I used to have about 5 years ago.

I more than likely owe this money, but there are a couple of things I'd like to check:

  1. Confirmation that I owe the amount stated
  2. That Lowell are ok to receive payments for it
What are my options with this form now? It says I have 14 days to respond. If I admit liability and offer to pay in instalments, does that mean I will have a County Court Judgment against my name?

    I never said anything about when I first heard, I'm just looking for a bit of advice about my options now.

    Without going into all the lurid details of where these debts stem from, it's a bit difficult to explain.

  • if i was you id check that the debt isnt 6 years old because if it is they cant chase you for it.something called statute barred or something.as long as you havent acknowledged it

    file an acknowldegemtn of service stating that you intend defending the claim in full

    this will give you a further 14 days from the date of service this making 28 days for you to file your defence in full or your part admission.

    If owed and not stat barred, offer them if you can £2k in full and final. CCA them and place the debt in dispute, on the form put that you dispute the claim etc and then lowell will have to put it through a normal court rather than the bulk processing center.
