HELP PLEASE............
I have had a letter in return from HBOS, saying "as a good will gesture" they will refund me £835 of charges, but my claim was originally for £5000, now they say in all the letter and jargin that this is not a final settlement and that it is just a good will gesture because i am in financial difficulty........
now basically the letter says that if i accept they will re-investigate if the court case goes in "my" favour. BUT on the agreement letter that i sign it says that i accept this sum as a settlement.. now to me the letter reads yeah yeah we will give you the £800 and if the court case goes in your favour we will give you the rest..... but then the bit i sign i read it as i sign that, thats all i get no matter the outcome, has anyone else had this similar problem, i really dont know how to deal with it...

They cannot seek a full and final settlement as per the FSA waiver:(16)
if the firm attempts to resolve a relevant charges complaint after 27 July 2007:
(a)
the firm must not seek agreement from the complainant that the resolution is in full and final settlement of the matter;
(b)
in relation to such complaints, if the outcome of the test case produces a result that is more favourable to the complainant, the firm must take all reasonable steps to pay any difference in the amount of compensation actually received by the complainant and that that the complainant would have been entitled if his claim has not been settled by the firm then; and
(c)
the firm must explain the implications of its approach and commitment;
you should be fine signing it or you could always amend it with your own wording.0
