Today I telephoned atlantic to see where my refund payment had gone and was told that since I had moved over to the social tarrif I would not be getting one any more !

Well news to me since I was told catagorically last october that moving to social tarrif would affect nothing else; it was all done on the phone and three people whos names I have told me that refund payments would not be effected; not much use though as i received nothing in writing except my first bill headed "Energy Care".

Now I know my units are cheaper; but surely if they change my terms and conditions I should receive a new contract to sign. And to add insult to injury the phone op tells me I have also lost my DD discount & loyalty discount ! Bravo Atlantic

But never mind thay say my overall bill should be cheaper, talk of trying to hit a moving target.

What I want to know is anyone receiving a refund or expecting one; who has moved over to social tarrif ?

Atlantic say no one is; however last october they said nothing in my contract would change other than the unit price.

I do hope their not telling Porkys.

I think that is the whole point of a social tariff - you can get the best price month by month or quarter by quarter without committing to pay by MDD etc.

It sounds as if you were clumsily advised so I suppose you could always complain about being mis-sold and demand you are backdated and put back on the more expensive tariff, if you like.

Atlantic do not offer a social tariff. Southern Electric which is the same company do however so you will have been "switched to Southern Electric" then put on their energyplus care tariff.

My ex is on the social tariff with Hydro, same company as Atlantic. She didn't get the price increase in August last year which was about 20% elec and 30% gas. Therefore she is paying rates 20% lower than last summers prices.

So for arguments sake if someone on sse social tariff paid £100 per year per fuel before going on the tariff, the bills would drop to £80 per year per fuel. Then there was the price increase which would push the elec to £120 per year and gas to £130 whilst the social tariff customers stayed at £80 per year per fuel. Saving £40 per year on elec and £50 per year on gas. Pretty damn good when you scale it up to your actual rates.

Based on this you really shouldn't complain as you're a hell of a lot better off.

Regarding your T&C's. It states in the T&C's that your tariff can change therefore you don't need to sign a new contract. Your T&C's didnt change only your tariff.

Request copies of those thelephone calls - might cost you a tenner to obtain.

Then make an official complaint over mis-selling.

Once proven, they'll probably either offer you a goodwill gesture, or agree to re-bill you on the more expensive tariff you were originally on, or perhaps both.

They have agreed to apportion and pay my rebate up to when they switched me over last october (8 months). However no more rebates/DD discount/Dual fuel discount/loyalty discount from now on. I havn't a problem with with this if its cheaper in the long run but at some point Gordo will either get booted out or change his mind about this tarrif and hey presto back to a *hit deal.

I guess its then time to change to a new company; I just feel completely misled having confirmed with three people that my deal wouldn't change; and no they don't have recouse to telephone transcripts; would never have guessed.

Don't ask for a transcript, tell them you want a copy of the actual recordings you can rightfully obtain under the Data Protection Act 1998.

Whenever I have phoned SSE, they always advise me the call may/will be recorded; I'd be very surprised if they haven't recorded the ones you say you made.

If you don't get anywhere on the phone, put your request in writing to their 'Data Protection Compliance Manager'

Most companies only hold calls for a short period of time, usually no more than 3 months due to the amount of memory space they take up. i know my employer only holds calls for 30 days before deleting them. Companies are not obligated to hold them longer than this i dont think
