Help!! Council fine me, move & damage my car in one day!!!

    The car could have equally been damaged by other means. I would try get some sort of independent written report stating the damage must have been caused by moving the car.
  • anewman - what kind of independent person could i go to for this?

    I still havent heard back from the council about either parking fine or the damages. Citizens advice werent very helpful when i rang up but think i will go in tomorrow - they should be able to help me by getting someone to write a letter apparently.

    Havent got quotes for the damages yet as i dont want to move my car since they have - im assuming if i use it before anything is sorted they'll pretend it was me afterwards

    Also, i've been advised to go to the police and make a complaint and get a ref number. They should be able to help me out right?

    Local newspaper is now involved too.. maybe that'll make them actually contact me!!

    To the person who thinks i'm talking tosh, if you check, you'll find that all parking bays have to conform to certain regulations regarding length and spacing of markings. For instance, if a bay has single end-of-bay markings at one end, then it must have the exact same markings at the other, if not, then the bay has no existance in law as far as parking charges are concerned.
    Its a bit like the double/single yellow lines rule, ANY breaks render said markings un-enforceable.
    I had a whole load of info on parking bays ('til I tried installing Windows 7, and it promptly trashed both the partition it was on & the one containing my XP install), If I can recover it, then I will post a link to it.

    Adjudicators can and do rule de minimis.

    Oh dear. You didn't read did you.

    Explain to me the relevance of the legal compliance of a bay if said bay does NOT EXIST because it is suspended?

    Yeah but suspending a bay while a car is parked there is as ludicrous as painting double yellow lines along the road while a car is parked there then fining it.

    Really? So if the council put up notices, saying that a bay will be suspended, giving, say 2 weeks' notice, they shouldn't then suspend it because someone's not bothered to attend their car during those 2 weeks or because someone has parked in the bay just before suspension is due to start? It doesn't work like that.

    Not bothering to attend their car.... I was away for some of the time and the rest i just didnt use it as i only mainly use it for when im working the club nights and getting out at unsafe hours. There were no signs when i parked, neither was it suspended when i found my car missing, i just found someone else's car parked there. The council have still not yet even been able to give me a reason as to why the bay was even suspended. Im with islington council... if they did even give notice of suspending the bay, they would have noticed by car didnt even move an inch during this time.

    My post was simply in answer to a previous post about suspending bays (not a slight on anyone who leaves their vehicle for a period of time). The council can and do remove vehicles. However, they have to follow the correct procedures.

    Have you sought advice from pepipoo, as suggested?

    Havent heard of pepipoo until now but will look into that. Have a police crime number now too, but my insurance are saying they wont doing anything so the council better do! Just found this from an old islington leaflet:

    "Sometimes we need to put
    a bay out of use and suspend or
    partly suspend the space for
    specific purposes such as building
    works, roadworks and house or
    office removals.
    When we can, we will warn
    you about suspensions by
    displaying a notice at the bay. We
    also show suspensions with a
    yellow hood reading ‘No waiting,
    no loading’ on the sign, or by
    placing yellow ‘No waiting’ cones
    in the bay. Please do not park in
    suspended bays, you might
    obstruct essential works."

    Doesnt mean if i was parked their already they can just damage my car though....'when we can notice you' pft..
