Should I appeal

I have just been given a £50 fine on a council car park for parking on the white line, I actually parked on it on purpose to give me room to get the pram and baby car seat out withouut scratching another car. The car park had NO baby and mother spaces and holds about 200 cars and was no where near full.

I have rung up and they said put it in writeing,

do you think this is fair,
also where is Martins template letter?

    Was this whiye line a bay demarcation line ? Were you penalised for 'not parking wholly within the bay'. Unless the wheel or wheels were wholly without the bay then you should win on de minimis as others have. Are there photographs ?

    The white line was a bay demarcation line, some of the tyre was on the line some was probably to the other side of it, I didnt take any pics I only saw the penlty notice when I got home ! Im just planning my appeal email, any help appreciated.

    Ask the council for their photographs. My recollection is that the tyre has to be wholly outwith the line. please measure the bay and take photographs of the bay including both ends end of the whole set of individual bays showing the delineation markings.

    It depends what the signs say. I know that Bolton were taken to the cleaners when their signs said you would receive a PCN if you did not park within a bay. They didn't make it clear that you should park "wholly" within the bay.

    I agree, that can be significant if present - and reflected in the TRO. Hence my point about taking measurements.
