Capital One with the FOS - still adding charges - can I claim them?

Hi all

My Capital One account is currently with the FOS (I'm claiming back £340 in charges but after using the template letters they offered me a goodwill payment of just £48 which I rejected).

However, as my account is still over its limit Capital One keep adding a £12 charge per month on top meaning that the £340 I'm claiming for has now gone up to £364 with an extra 2x £12 charges added on.

Should I tell the FOS this? I.e. do I claim back £364 now rather than the £340? IF I win this, it would basically be enough to settle the account which I'm aiming to do so it would be good if they just refunded this account so I could close it.

Any advice would be appreciated.

    You will get them all back, the bank will backdate them all by default, but whats to stop them charging you again once you had a payout? Mmmm, i am just waiting till October for the ruling and going from there.

    Well (hopefully) if I receive all the charges back, this will be enough to pay off the debt with them (it's relatively small, one of my better ones...) and I will close the account once and for all.
