Mobile phone repair

I recently had to take my mobile phone to Carphonewarehouse for repair, it was there for 3 weeks before I was told that it was ready for collection.
I collected it today from the store about 8 hours ago, well exactly the same fault has now occured to the phone would I be within my rights to now ask for a new phone as they told me it was repired only for the same fault to reoccur only hours later?
The repair was carried out under warrenty.

I too am battling with legal isues on faulty phones. I did se a consumer lawyer talk about this issue regarding kettles and it's very clear. You can give them one more chance to repair th handset. However, if it still isn't fixed on the second attempt you are well within your rights at that point to demand a replacement as the goods are 'beyond reasonable repair'. Of that I have no doubt. You are under no obligation to keep on accepting 'repairs', Hope you mnage to battle them and win - let me know0 -

One of the phones buttons keeps pressing itself, I actually managed to send about 50 blank text messages to someone without knowing about it.
All this actually happened while the phone wasnt in my pocket and I have seen it do it again today after it was supposedly repaired0
