Start of a long road

Hi All

I lurk around most days but don't often post, just thought i would share what my biggest fears are RE going bankrupt. Hopefully some of you out there will have had the experience / knowledge to maybe put my mind at ease.

I have 32.5k of debt and due to having to start renting a place on my own (previously with parent) I have even less hope of being able to pay it off.
So BR is the only option for me, which in itself doesnt bother me as beyond wanting to eventually own my own place (im only 23 so plenty of time to save the huge deposit i will need) i never intend on having credit again.

But here are my concerns:-
I have a contract hire car which this month will be the first time i have missed a payment, when is the right time to hand it back? Should i call them and let them know that i am about to be BR and need to return the car? If so what can i expect?

Also in Scottish law for me to apply for my own BR i need a creditor to send me a "charge for payment" or concur with my BR. I have heard that this can take up to 14 months and I am now beginning to wonder what actions they will take in that time and how much i will be able to withstand. Will they try sending baliffs round? As i am a 23 year old female living alone and would be terrified if that happened.

Also i may be wrong but i think the "charge for payment has to come from the court and be delivered by the court so i don't want to answer the door in case its a baliff but i want the "charge for payment".

I feel like i'm in a bit of a catch 22 situation here, any advice??

    The rules in Scotland are completly different to the UK and most of us don't have the experiance. I am going to send a PM to one of our Scottish members to have a look at your post.

    Thanks Tigerfeet, I'd also be looking for a template letter to ask for creditor concurrance if anyone one out there has such a thing? Not the best at wording these things on my own :confused:

    Thanks again, i did try there without luck......every other letter except that one.

    I'm beginning to wonder whether a creditor would ever concur :confused:

    Give NDL a ring and ask them to help you with the wording of the letter which you want to write.

    Thanks, i have already looked, but will try and pick bits out of a few different letters to see if i can make them apply without sounding stupid.

    I'm not completly useless but when it comes to this kind of thing i'm stumped for words to get my point across.

    If only i could enclose the form with a post-it note saying "please sign" :rolleyes:
