Definition of Financial Hardship?

Hi; First Post so apologies if this is covered elsewhere.
I am self-employed with tax arrears, credit card arrears, mortgage arrears, council tax arrears and bank overdraft, and struggling to pay day-to-day bills. I have no savings, however I have approx £100,000 collateral in my house. Does this collateral bar me from going down the financial hardship route in reclaiming my bank charges (approx £5,000 over the last 6 years). Thanks

And the charges goes back to 27th July 2001

It's a personal account. Arrears are being paid as and when I can. No court action (yet).0

The process for reclaiming under hardship is above. I would add that in my mind its a 50/50 chance since the arrears are being paid off as and when.
If you have the list of the charges then send the first letter plus an income and expenditure form and any arrears notices from the priority debts.0 -

Maybe that may not be a good idea, last thing we want is people throwing up these days
