    I just emailed the financial Ombudsman's office - technical.advice@financial-ombudsman.org.uk
    about these people, given what i have now read on here...really wish I hadn't sent the forms back originally now.

    I have now received from Banksmart questionnaires on two companies (one they approached me with & one I added) to sign & return, which i'm not sending back until I hear from the above

    I await some good information

    The Financial Ombudsman does not deal with complaints about Claim Companies, you need to send your concerns to the LEGAL Ombudsman.
    However, the Ombudsman cannot act until you have given the Claim Company eight weeks in which to rectify the problem(s). You do this by FIRST making a formal complaint to the Claim Company.
    If you have received poor service from a CMC and you wish to refer a complaint against them to the Ombudsman Service, you must first make a complaint to that organisation and give them eight weeks to deal with your complaint.

    Just spoke to the Legal Ombudsman I am within the 14 day cooling off period & have e mailed them (BANKSMART) all three e mail addresses with all relevant documents attached including the questionnaires unsigned

    will also be sending the hard copy documents to them registered/signed for post

    hopefully this should see this off

  • Earlier this year I replied to a text message claiming I had ppi to be claimed, I wish I'd never of even bothered as it has now turned into a complete head ache & worry now reading all these posts from years ago and some more recent!!

    I basically filled out all paperwork Bank Smart sent me no even thinking weather it was no win no fee as pretty much every company that does this is & takes their cut out of the final claim which is fine by me.

    They had everything they need to make a claim and had even contacted me to say so but continued to ask for further details, I didn't fill these forms out and just binned them (foolishly I know now)

    The last letter was basically telling me that two bank charge claims were not successful but one ppi claim did have something to claim for but again they asked for more and more information on this account to proceed. I know for a fact that the account (a mortgage account) was cancelled of ppi a few years after I opened it so knew this would be much so I just cancelled the claim. They now want £237 off me purely for cancellation fees, I've told them I am willing to pay this but purely if they re open the claim and take it out of the claim money! I've also asked that how can they charge me for cancelling the two bank charge claims when they said that they didn't have anything to claim for? I was just closing them two claims.

    CMC's are tricky like this. in the smallest of small print you'll find it does say that if you contact them to cancel a claim you have with them you'll be liable for a cancellation fee.....

  • I'm same boat with these bunch of rip off merchants . Unsuccessful claim 3. Years ago now trying to bill me for cancellation and work carried out . Constant letters threats and doorstep collectors . Now a letter today issuing court proceedings to obtain a ccj for nonpayment of £450.00 what a joke . I really want to make an example of these people . I feel they spend most of their time issuing threats and sending work to debt collection agencies than actually recouping any Refunds ! Their legal department must be massive ! -anyone else on same boat with court letters from these people ? :mad:
  • Hi ,yes I have the same issue £400 bill,but am seeking help from Citizens advice,they are telling me to keep replying to all letters but now have a new form to sign which mentions a company called Symmetric systems and for me to sign for them to take over,will speak to Citizens advice later today to see what they say a,also am going to see what my bank know about it all...
