Boundary Fence Problems

I have the ends of 16 other back gardens backing onto my garden, the fence which seperates the gardens Is denoted on my title deeds with an inverted T . I have replaced near on 100 feet of this fence duee to a poor state of repair. One neighbour however claims it is her fence and that it states this on her deeds. I believe the fence she is talking about is no longer there as there is evidence of an old boundary line in some gardens.

Am i right in replacing the fence it even says in the restrictive covenants that I am maintain the boundaries marked with a T and to ensure they are the same form wheather fence or hedge.

Can she stop me erecting the new fence ??

I have pdf files of both land registry title deeds and transfer covenants for BOTH properties if any one would help me by look ing at these please

  • I'd sit down with your neighbour and compare deeds so that it is clear who owns what and everyone's happy. I wouldn't want to fall out with them for a stupid misunderstanding.

    So is she offering to pay for the replacement fence ?

    A good website to try for advise over house matters is channel 4s home section ( sorry dont know the address) the forum there has quite a few legal bods etc who may be able to help.

    Perhaps if you suggested that as you both feel you own it you split the cost 50/50, as long as it isnt moving or be changed surely she cant argue with that !
