Declaring old debts

Hi hope someone can help

We are about to apply for one of the shared ownership schemes to buy our first home and we are not sure if we need to declare old debts,

Years ago (mid 90's maybe) I had a CCJ (at least I am sure I did) against me for non payment of council tax which I obviously paid in full and it is no longer on my credit file and I now have a very good credit score.

My H on the other hand had a loan that he defaulted on about 6.5 to 7 years ago which while he never paid it in full (before I met him) it is no longer on his credit file. His credit score is not as good as he has nothing on it really as he has not applied for credit in years and has anything at all in his name.

So I am about to fill out the forms and it asks if I have ever had a CCJ registered against me, do I say yes about 15 years ago or as it is no longer on my file can I finally be free of it and not have to declare it?

The same goes for my H, even though his debt is now stat barred and his is no longer on file, will he also still have to declare it?

If we do have to declare it, will we always have to? And if so, wont that mean that our past teenage mistakes will forever blight our adult lives?

    if it's not on your credit file, then don't complicate things ! Bancruptcy WOULD have to be declared. Ignore the ccj's

    If the form says "have you ever had a CCJ" and you say no, that is a blatant lie, and if it comes to light could cause you a whole load more problems in the future. It is also fraud.

    so declare it and suffer 'any penalties' they may impose. They take their own CCJ check and after 6 years,, they 'disappear'

    I personally would not be confident in saying the lender will not find out about the CCJ.

    If they ask you directly, you have to tell them that you had a CCJ registered against you. If they don't ask, you are under no obligation to tell.

    I guess I always knew you should declare it but would have thought you should be able to start afresh and shouldn't have to declare it if it is past the 6 year period or people like me are just never going to get a mortgage are we?
  • I had an IVA (much worse than a CCJ) which finished last year and have passed the credit score for a 90% Britannia mortgage. They just need to finish the employment references before sending out the mortgage offer.

    My credit file is clear as the defaults have dropped off as when i applied it was 6+ years from the default date.
  • Just a thought, but if you do not pay council tax it is not an issue for the county courts therfore you can never get a CCJ.

    Yes, serendipity, you are quite correct. For council tax, you would have a liability order. A liability order is NOT a CCJ.

    You can find out through http://www.trustonline.org.uk/ about County Court Judgements that are held against an individual or business. You have to pay £8 per name to find out this supposedly public information. You can get 5 for £30.
