Missing items- what to do?

Hi, I have bought over 150 items from E Bay in the past and never really had any problems up until now.
Last week I bought a "job lot" of 14 Cds in an auction, most of which I already have but I thought they would be nice for my friend who is just getting into my favourite band.
Two of the Cds were worth a lot more than the rest which can normally be picked up for between 49p and 99p each. The one which was actually highlighted in the heading as being included can sometimes fetch £10 or more so I was pleased to win the whole lot for £22 which was a good price.
However, when the parcel arrived a few days later (by recorded delivery) the main CD I wanted plus two others were not in the package. I e-mailed the seller immediately, twice in fact a few days apart each time as he didn't reply. Eventually after 6 days he replied this morning, said he couldn't get to a computer which was why he didn't respond and that he was "100%" certain he had put the cds in, had searched his house and they weren't there and that the parcel must have been tampered with in the mail!"
He also said he had a receipt with the weight on it and this would show if any had been removed.
Well the parcel was perfect when it arrived, it clearly had not been tampered with so I have written back yet again to tell him this.
I am so disappointed that the very Cd I wanted and was advertised as being special is one of the missing ones. I know I could claim a refund but I'm annoyed that I might have to pay for the return postage (which was £4) and I have also missed out on a good purchase. I hope that he hasn't kept back the more valuable ones to sell on individually although obviously I have no proof of this.
Sorry it's a bit long winded, does anyone have any advice please?

Unless you can come to any other mutual agreement, claim for SNAD. You'll need to send the item back at your expense (use a service with online proof of delivery) and then you'll be entitled to a full refund of what you originally paid."Now to trolling as a concept. .... You could just see if the seller was willing to refund some of your money for the missing CD's. It'll work out cheaper than sending it back as they don't have to pay for your return shipping costs unless they want to (and usually they don't). If I make a mistake I would much prefer to refund some money than have the hassle of having the items returned and then refunding the money and then relisting them etc...0

Did you check the weight he stated - just interested if it was hugely different...?0

Thanks, I'll see what his response to my latest e mail is, a partial refund might be better but I'm annoyed all the same. At the moment I've paid at least twice what I should have for the value of the ones I got.0
