  The company Gîtes de France Services, hereinafter "the organiser", a sole proprietor company with limited responsibility (EURL), of French nationality, with a capital of 600 000 Euros, head offices at 56 rue Saint Lazare - 75009 Paris, registered in Paris, France, under the number 350236006, is organising a free contest, with no purchase obligation from Wednesday 29th of April until Tuesday 18th of August 2009.
  
  The contest, the sites and the interpretation of the present rules are subject to French law. The contest is accessible on the following sites, hosted in France:

• <LI class=puce>Article 2 : CONDITIONS OF PARTICIPATION

  The inscription to the contest implies the unreserved acceptance and respect of the present rules and conditions, which are accessible on the site at the inscription of a participant and at all times during the contest on the site.
  
  2.1 Conditions of inscription to the contest
  The participation to the contest is available to any person of 18 and over, residing in Metropolitan France, except the organiser's personnel as well as the employees, and the members of their families, of the companies having taken part in the organisation of this contest.
  
  Anyone wishing to take part to the contest must inform the organiser of his/her civil status, full name, valid email address and whether he/she wishes to receive offers from the Gîtes de France®.
  
  2.2 Information concerning the participants
  In agreement with French law " informatique et libert!s" on personal data of 6th of January 1978, as modified, the participants have the right of access to and the rectification and suppression of information concerning them with the organiser of this contest during the duration of this contest hereinafter:

  Subject to their consent, the information collected concerning the participants will be used in order to give them better attention and inform them of new products and offers which could interest them.
  
  
  2.3 Validity of the participation
  The information and details supplied by the participant must be valid and true and will otherwise entail disqualification and eventually loss of the winner status. It is strictly forbidden to modify or try to modify, in any way, the proposed contest's provisions, in order to modify the results or influence by any automation or unlawful means the draw's validity or the designation of a winner.
  
  Should a participant who has been drawn or won a prize in breach of these rules, by means of fraud such as an automated research or the use of algorithm or by means other than those described by the organiser on the Site or in these rules, the prize will not be attributed and will remain the property of the organiser, without prejudice to possible proceedings against the participant by the organiser or a third party.
  
  It is strictly forbidden for a participant to take part in the contest with various email addresses as well as from a contest account opened in the name of another person. One and only one account will be open by one and only person under the same full name, email address and domicile.

• <LI class=puce>Article 3 : PRINCIPLES OF THE CONTEST

  3.1 Mechanics of the contest After registering, the participant may increase his/her chances of winning; there are various possibilities available:
  
  - He/she may be given 3 extra chances of winning the draw by answering a question regarding the "Gîtes de France". This stage is renewable every 15 days (with a different question each time).
  - He/she may be given 5 extra chances of winning the draw by answering 5 personal questions (his/her department, age group, profession…). This stage takes place only once.
  - He/she may be given 1 extra chance of winning the draw by sponsoring a friend, knowing that he/she may sponsor up to 3 friends at once. For this purpose, he/she should manually register the email addresses of the people he/she wishes to sponsor in the area indicated to this effect. The email addresses given must be valid and different one from the other in order to be taken into account for the benefit of the participant. This stage is renewable.
  
  These operations that can be carried out by the participant shall therefore contribute to increase his/her chances to win the Contest "Gîtes de France forever", but will also allow him/her to take part to various draws taking place every 15 days, in other words on Thursday 14th of May 2009, 28th of May 2009, 11th of June 2009, 25th of June 2009, 9th of July 2009, 23rd of July 2009, 6th of August 2009 and 20th of August 2009.
  
  The contest organiser and the operator, on behalf of the organiser, process the traffic and connexion in formation to the contest site and keep the IP address of the computer used by the participant in order to establish statistics regarding the site visit, to guarantee the site's security and verify the genuineness and honesty of a participation to the contest and its compliance to the rules, in particular to avoid or detect any automated search on the contest's sites or any automated invitation sending to a third party which would systematically result in the exclusion of the participant and the benefit of prize and would expose such participant to proceedings by the organiser or a third party against him/her. If need be, the organiser will put at the disposal of a third party or the public authorities these traffic information, in agreement with the law.

• <LI class=puce>Article 4 : PRIZES

  The contest comprises the following prizes:
  
  - Conditions applicable to all the stays:
  
  The stays comprise the accommodation (and breakfast for stays in chambre d'hôtes); all other supplementary service will paid for by the beneficiaries. The beneficiaries will pay for the journey from their domicile to the place of the stay as well as the return journey to their domicile.
  The client will pay the tourist tax. The tourist tax will have to be paid at the place where the stay will take place. Should it not take place, the stay will not be cumulated, postponed, reimbursed and will not be taken as a replacement for stay already reserved by the beneficiaries with the reservation and direct rental offices.
  
  
  - 8 stays worth 400 Euros, all taxes included, in chambre d'hôtes with "Gîtes de France" quality-label; each of the departments taking part offer a single stay to be won. For each one of the stays, the winner will have to make a choice according to the availabilities in terms of dates, chambres d'hôtes configuration and location of the stay, in a chambre d'hôtes with "Gîtes de France" quality label to be selected in the department drawn. The stay should take place before the 31st of December 2010.
  
  The list of the departments taking part and the specific conditions of some of them is as follows:
  
  - Ardèche: the prize is represented by a purchase voucher.
  - Brittany: the winner may choose to stay in one of the chambres d'hôtes with "Gîtes de France" quality label located in the following departments: Côtes d'Armor, Finistère and Morbihan.
  - Haut Rhin
  - Haute Garonne
  - Haute Saône
  - Loire: the winner may only choose to stay in a chambre d'hôtes with "Gîtes de France" quality label that can rented through reservation office.
  - Tarn
  - Vaucluse
  
  - 8 stays worth 800 Euros, all taxes included, in a rural gîtes with "Gîtes de France" quality label; each of the departments taking part offers a single stay to be won. For each one of the stays, the winner will have to choose according to the availabilities in terms of dates, gîtes configuration and location of the stay, in a gîte with "Gîtes de France" quality label to be selected in the department drawn. The stay should take place before the 31st of December 2010.
  
  
  The list of the departments taking part and the specific conditions of some of them is as follows:
  
  - Brittany: the winner may choose to stay in one of the rural gîtes with "Gîtes de France" quality label located in the following departments: Côtes d'Armor, Finistère and Morbihan.
  - Cantal
  - Corsica
  - Haute Garonne
  - Haute Vienne: the winner may only choose to stay in a gîtes rural with "Gîtes de France" quality label that can hired through reservation office.
  - Manche
  - Vaucluse
  - Vend!e
  
  - 1 stay worth a maximum of 1500 Euros, all taxes included, to be reserved each year, for life, in Metropolitan France in accommodations with "Gîtes de France" quality label, according to availabilities.
  
  In order to be able to make the reservation and register the winning, the winner will have to abide by the following conditions:
  - The winner designated by name is the sole beneficiary of the stay won.
  - The winner designated by name must inform Gîtes de France Services as soon as the reservation has been made with the reservation office or with the owner in case of a direct rental.
  - If the winner does not use a year won the stay will be lost and no other alternative will be given.
  - Not using, once only, the stay won will mean giving up the winning in the future and constitutes a reason for tacit termination. - No money compensation can be granted.

• <LI class=puce>Article 5 : WINNERS NOMINATION
  
• 
  Regarding the contest "Holidays forever", the winner's nomination will be carried out on the 27th of August 2009 by means of a random nomination algorithm filed before the bailiff trustee of these rules.
  Regarding the draw renewed every 15 days, the same mean as the preceding will be used.
  
  The winners will be nominated once their eligibility to win the corresponding prize has been verified.
  
  The participants nominated during the draw will be contacted by email, by the organiser, within some 15 days following the draw. If a participant nominated during the draw does not give any reply within 30 days following the email, he/she will be considered as having renounced the prize and it will remain property of the organiser. The winners' full names will be available on sending a stamped envelope with the name of the applicant to the organiser at the address given in article 6 below, during the month following the draw.
  
  The organiser may publish on and off line the full names as well as the prizes won by the winners on the Internet site of the Gîtes France, in the press, in the Gîtes de France publication in order to promote the contest.
  
  The winner will have to comply with rules. Should he/she not comply with the criteria of these rules, his/her prize will not be attributed. The participants authorise all verification concerning their identity, age, address or the honesty and sincerity of their participation. All false declaration, indication of identity or false address will mean an immediate elimination of the participant and eventually the reimbursing of the prizes already sent.

• <LI class=puce>Article 6 : FREE PARTICIPATION

  The participation is fully and completely free. The expenses incurred for the participation to the draw through Internet will be reimbursed on request, exclusively by mail addressed to the contest's organiser:

  The reimbursement lump sum corresponding to eventual expenses for taking part and connecting to know the results will be of 0.61 Euros.
  
  If needs be, all request for reimbursement will have to be sent within 15 days following the participation and include the following documents and information concerning the participant:
  - Full name, postal and email address
  - A photocopy of the identity document
  - The date and time of participation
  - When available, photocopy of the Internet service provider detailed bill. This photocopy will be used as a domicile justification.
  
  No reimbursement request sent by email will be considered. Nevertheless, all free or flat fee connection to the site (with a cable connection, broad band, wireless internet or special connection…) will not be considered for reimbursement since the connection will have not meant any expense or specific cost for the participant.

• <LI class=puce>Article 7 : RESPONSABILITY
  
• 
  The images used on the sites, the objects represented, the brands and the commercial denominations used, the sites' graphic and IT elements and data bases are the exclusive property of their respective owners and cannot be extracted, reproduced or used without their written authorisation, on pain of civil and/or penal prosecution.
  
  Any resemblance of persons or elements of the contest with other fictitious persons or other pre-existing elements is purely fortuitous and cannot engage the responsibility of the organiser or of its eventual contractors acting for it. The organiser or its eventual contractors will not be responsible if, in case of force majeure or any event beyond their control or justified by necessity, they should have to annul, shorten, extend, postpone the contest or modify its conditions. The organiser, in all cases, reserves the possibility to extend the participation's period.
  
  More specifically, the organiser or its eventual contractors decline all responsibilities in cases in which the site might not be available during the contest, or in case of malfunction of the automated prize draw procedure that could not be attributed to it, or cases in which information provided by participants were to be destroyed for a reason that could not be attributed to it.
  
  All practical difficulties related to the application or interpretation of the contest (as well as unforeseen occurrences) will be decided without appeal by the organising company.
  
  The organiser or its eventual contractors reserve the right to replace any prize that might be unavailable by another prize of equivalent value.
  
  The prizes cannot give rise to any dispute or complaint of any kind, nor can they be exchanged, nor can they be the object of a payment in cash on the request of the winners.
