Buyer taking the mickt

Hi all, have a buyer who bougt an item off me 2.5 weeks ago Buy it now etc.
After 1 week fo not paying emailed buyer to ask what was going on, he/she said they couldnt pay for item with cc (even through paypal!). I am a premier user of paypal and have had no problems in past with people using debit/credit card to pay me instantly etc.
SO fastforward another 3 days.. i start a case to just cancel the transaction... Buyer claims its my fault he cant send payment... and he says he will pay (dunno how as we are in limbo with me being charged a FVF!)
So fastforward to todm;ay, i;ve send multiple ebay messages requesting his paypal email and giving him mine to pay manually or me to request money from him..
This has fallen on deaf ears.... I feel frustrated because he./she is just ignoring me and hasnt even bothered to pay for item for an issue that may or may not exist. I feel like being messed around like.
Trouble is now i cant open another case as the original was closed with him saing he will pay for item.
I dont want the transaction to continue now with such a cruddy buyer (ignoring emails except when a case is opened and then cancelling request to cancel a transaction that according to him cant go ahead due to tech difficulties) but I cannot opeen another case.
Question is... when can i open a nother case? Never? I think ebays system sux, ive got a buyer saying 'yea yea i will pay but it wont let me' and '....' when i request emails or communication to move things ahead... yet he can simply say he will pay in ebay case and ebay says 'screw you seller' and just makes you sit in !!!!!!!g limbo land!

Nothing you can do now except chalk it down to experience.
Many people, myself included, have trusted people who respond to a dispute claiming they will pay, then hastily closed the dispute, only for nothing more to be heard from the "buyer".
Since then, I only close the dispute not only after the payment has been received, but only when the feedback is left or proof of delivery is available online.
I always send items recorded after a dispute as well - it's too easy for someone to open an Item Not Received claim in retaliation for opening an unpaid item dispute against them.<--- Nothing to see here - move along --->0 -
i didnt even close the dispute!... Ebay closed it. Thats the annoying thing0

I tried to select the option not to give them a strike and then they send a snotty reply:
purchased the product because this is what i need the reason that it has not been paid for is due
to no facility being available from you. There is no paypal facility and you have set it up to contact
yourself to pay by visa card if you do not have the facility to pay by visa it is therefore not my
request to cancel but your own therefore you need to take action to remove it as i still want to
purchase the product accepting your request impacts on a perfect purchase rating i have aquired0 -

You opened a Mutual Cancellation request, not an unpiad item dispute.
As they are both processed as a "dispute", you have lost your only chance to get the fees back I'm afraid.
Again, it's very, very rare I would use a mutual cancellation - the "buyer" simply has to press the wrong button, and the chance of a FVF refund is gone.
On the positive side, you'll not make the same mistake again!<--- Nothing to see here - move along --->0 -

I think that is quite clear and doesn't indicate anywhere that you get a second go at a dispute.
I realise it won't help you, but this is why I always urge against using mutual cancellations it is an extremely rare situation that one should be used and NEVER with a buyer who can't work out how to pay in the first place.
Unfortunately there is now nothing you can do, there are no appeals against opening the wrong dispute and you have no way of either reclaiming your FVFs or giving the buyer a well deserved strike.
