Hi all,
Can anyone tell me what they think of my T&C's for my website and company. I have used alot of other peoples text etc for this and added a few bits myself.
The following are terms of a legal agreement between you and CNB Computers. By accessing, browsing and/or using any service advertised on this site and the server it's hosted on, you acknowledge that you have read, understood, and agree to be bound by the terms below and to comply with all applicable laws and regulations. If you do not agree with these terms, don't use this site.
1. Website Usage
1.1 The content of the pages of this website is for your general information and use only It is subject to change without notice.
1.2 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. 2. Definitions
2.1 In these terms and conditions the word 'Customer' refers to the person, entity, firm or company ordering products or services from CNB Computers.
3. Contract Information
3.1 All order or appointment requests submitted by the Customer to CNB Computers and accepted by CNB Computers shall be subject to these following terms and conditions which shall form part of and govern any Contract.
3.2 Usage of any service or receiving any estimate or quotation for any Products and/or Services by the customer, issued by CNB Computers -verbally, by phone or in person or in writing including by email- shall be deemed acceptance of these terms and conditions.
4 Authorization
4.1 The customer authorizes CNB Computers to conduct an evaluation of the equipment/media to determine the nature of the problem and provide an estimate for the repair cost and time it may take. The evaluation is charged at our standard hour rate of £20.00 and no work beyond this evaluation will be charged without explicit customer approval.
4.2 The customer authorizes CNB Computers and its employees to receive and transport any computer equipment, other equipment, media or data to and from their facilities.
5. Legal Rights
5.1 The customer is the legal owner (or authorized representative of the legal owner) of any equipment, data or media given to CNB Computers.
5.2 Any property left with CNB Computers unclaimed for 90 days, will be disposed of. At which time, CNB Computers shall have no liability to the client or any third party.
6. Price
6.1 All prices for Products or Services stated in any quote, estimate or acceptance of order are those current at the time of the Customer's enquiry by phone, by email or any other acceptable means.
7. Payment
7.1 Payment for parts and services must be made by cash, cheque or internet bank transfer upon the delivery of the services by CNB Computers in some cases a payment upfront will be required on some parts.
7.2 The customer agrees that payment for services and carriage is non-refundable and parts or equipment fitted or supplied will be replaced only if found faulty and/or covered by the manufacturer's warranty.
8. Limited Liability
8.1 CNB Computers shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.
8.2 CNB Computers will make every possible effort to preserve their customers' data, however they make no guarantees whatsoever that data will be intact after the computer(s) / equipment have been repaired and tested. The customer agrees not to hold CNB Computers responsible for any loss or damage to data as a result of repairs, upgrades or any other services carried out on their computer(s) / equipment or network.
8.3 In no event will CNB Computers be liable for any damage to computer equipment, property, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if CNB Computers has been advised of the possibility of damages or loss to persons or property. CNB Computers liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services.
8.4 The customer is aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of CNB Computers, and assumes any and all known risks of injury and property damage that may results.
8.5 Any advice or recommendations given to the Customer by CNB Computers or its employees as to storage, application, use or preference of the goods is followed or acted upon entirely at the Customer's own risk and accordingly CNB Computers shall not be liable for any such advice or recommendation.
8.6 While CNB Computers will make every effort to preserve the integrity of any equipment under repair, the Customer agrees not to hold CNB Computers responsible for any accidental damages to the equipment in its possession including but not limited to surface scratches, deformations and cracks.
8.7 The client and CNB Computers agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at CNB Computers option, additional attempts by CNB Computers to recover satisfactory data or refund of the amount paid by the client. The parties acknowledge that the price of CNB Computers services would be much greater if CNB Computers undertook more extensive liability.
9. Confidentiality
9.1 CNB Computers agrees not to disclose any information or data files supplied with, stored on, or recovered from client's equipment except to employees of ARL Computer Services and where required by law.
10. Warranty
10.1 30 days Limited warranty on laptops/desktops that CNB Computers has repaired, CNB Computers makes no warranty on data, express or implied, and CNB Computers disclaims any data warranty of any kind. The client and CNB Computers agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at CNB Computers discretion, refund of the amount paid by the client.
11. Disclaimer
11.1 Although all attempts are made to provide accurate, current and reliable information, you should recognize the possibility that errors may exist in the information available on this Web site. CNB Computers expressly denies any warranty of the accuracy, reliability, or timeliness of any information made available on this Web site, and shall not be held liable for any losses caused by reliance upon the accuracy, reliability, or timeliness of the information. This is such a specialised area that you really do need to get professional advice - should only cost £50/60 to review what you have done.

I would include a late payment clause in your T&C but I am biased!0 -
