£12.00 fees - reclaim-able? (sorry if I'm duplicating)

Hi all
I have a credit card with Capital One (yuk), plus a catalogue, which has from time to time, been late in being paid etc ... usual excuses, same old same old ... !
Anyway, I have a lot of £12.00 fees (default fees which then become overlimit fees when they charge me the default fees!) and wondered if these are all reclaim-able?
I know that the guideline states £12.00 is acceptable, but is it still unlawful???
Any answers very gratefully received, so I can try and recoup some money to pay them all off!!!
I have my letter templates and 2 x cheques for £10.00 all ready to send off if they are!
