Reclaiming bank charges when in an IVA

I entered into an IVA recently, and would like to know what chance I have of reclaiming my credit card/debit card bank charges back from the banks, when my debts from these banks are included in my IVA. I'm also in financial hardship. My inheritance will go towards the IVA, and am not making monthly contributions.

Credit cards are easier to reclaim than bank charges and they will reduce the amount owed in total. Do you have priority debt arrears(mortgage/rent, council tax, utilities)?0 -
There was PPI with the credit cards.
I have mortgage arrears. Went to court to fight reposs, and we agreed on a much lower monthly payment. I've also now got help from the state towards monthly mortgage costs and Council Tax.
I take it that the banks would not pay me out directly, as all my accounts are in the IVA. I can easily prove financial hardship.0 -

From the details posted I think you would have to argue that the period in which the hardship started up to the point in which you went to court on the mortgage is the issue plus the council tax. TODAY, I would say that you are not in hardship since state help is paying the council tax and you have lower payments on the mortgage as it went through the courts.
PPI is a good shot. and there is a PPI forum so worth a post on that part of the forum.0
