HSBC breaking the law

I have read other peoples comments about HSBC , they deny that there is a Harsdship exception for bank charges.

I have folllowed all your advice and the credit consumer and they deny that there is such an exception.

I have read the financial ombudsman( Joke) ruling and have followed their advice to the letter, but still no avail.

What I could work out that this is only a temporary situation until the court case is decided.
I think that HSBC IS playing a strategic game of rejecting all claims initially to play for time as they are confident that they will win the case.

My question is how do I now proceed and take HSBS to court to claim my money bank before the expiry of the relief.

I hear all these success stories but it should not be stories but general ruling, I dont want any favours from the bank , just what I am entitled to from those legitimate criminals.

please reply as I am sick and tired of their being two laws , one for those the banks and one for the mortals

  • Ok, I have no idea what you are talking about since there have been payouts by HSBC. Let's look at your situation first of all.
    Do you have any priority debt arrears(mortgage/rent, council tax, utilities)?

    All banks should be able to deal with customers in financial difficulty whether there is a Test Case or not and the Financial hardship exemption does not mean an automatic payout even if someone is in hardship.

    I agree with your thread inregards to HSBC, me and my partner have tried to claim over £2,000 in charges in the last 6 years. I have written to HSBC twice once last year and then again this year using the template letters and listing all the charges.
    I see sucessful stories with other banks and none with HSBC there responce was they are not going to pay till the court hearing is complete.
    What made me laugh even more was a branch manager in the midlands said that HSBC had won the court hearing last year and that I could not claim my charges.

    Has anyone had any joy with HSBC???

    I too have been fighting HSBC, they refused my claim and said I wasn't in financial hardship ( what a joke) HSBC are clearly digging there heals in, and being very un co -operative.

    I was sick of the constant charges of £125 a month, I sent them the 2 template letters, got standard reply about test case blah blah blah.
    I sent a final letter saying if they continued to ignore me I will change my bank account. Well as they ignored my Threat I moved all my banking over to a new Natwest basic account.

    And decided HSBC can go whistle for there overdraft of £1000

    I would do that but its the hassle of changing all direct debits over ect.
    I recevied that standad letter too.
    I explained that if we didnt have the charges then evenually could be in credit but they dont seem to see that.......
    Every month charges just puts you more and more in the red.
    I even had a banking company approach me and say they would claim the charges on my behalf and I was to pay a fee of £49 pounds, so watch out for them, I thought if they can get my charges why cant I. I wasnt prepared to pay £49 quid.

    That sounds like a scam to me, stay well clear.
    As for changing everything over, I know its a hassel, but in the space of an hr, I had everything cancelled with HSBC and changed over to natwest. I used HSBC instore machine to cancel all direct debits. Then it was simply a case of contacting employer/ benefits/ Direct debits.

    I tell you the relief I feel now to look at my bank statement with NATWEST and see I am in credit, rather then debit. Its a great feeling, then I get that horrible niggly feeling knowing HSBC are still charging me and there is a debt sitting there needing to be paid.

    HSBC certainly have been the least un co-operative from all the banks.
    If only they could stop charging us and allow ourselves to get back in the clear, then this snowball effect of never ending charges would go away

  • Yeah i thought it was a scam too!
    The problem is I get paid weekly and would be in debit straight away with the new bank. I would need to credit the new account with £1200 to pay the bills.
    I have tried to space the bills out over the month but my weekly wage doesnt cover the morgage but over the month it does.
    The only other option I thought it save all my weekly wages up and then have all the bills go out at 1st of each month, but would fall behind a month if I did that.

    As mentioned in my thread, yes I am in rent arrears, however the council have agreed that I can pay an extra £20 off a month until the arrears are cleared. As thats all I could afford.

    Spotted it and have explained why it is not financial hardship and amethyst from legal beagles has given some other good advice
