Egg Card Reclaiming not going to plan

Had reclaimed successfully the PPI from my egg loan so thought I would give reclaiming the card charges a go. Filled in the template from here and sent it off. Got a letter back yesterday saying this:

"Further to your letter dated 8th July regarding the charges applied to your account, we do not accept that our charges are unfair or unlawful. AS a result we do not propose to refund the charges that were applied to your account upon your breach of the terms of the Egg card agreement.

....The OFT set a threshold for intervention of £12.00 but stated that default fees should not be equivalent to the threshold.

The OFT stated that the presumption of unfairness in relation to charges over £12.00 would not apply where there are exceptional circumstances, a card issuer may be able to set a fair default charge above the £12.00 threshold.

The OFT, as an example, specifically referred to Egg's practice of requiring all customers to pay the minimum monthly payment by Direct Debit.

Following the conclusion of the investigation, the OFT indicated that it would not proceed further against Egg on the basis that Egg reduced its chrages from £20 to £16. Accordingly, without any admission of liability as to the previous level of charges, Egg reduced its default charges to £16. The OFT have taken no further action against Egg.

Our investigation found that any charges applied to your account were at the rate of £16. For the reasons outlined above we are satisfied that our charges are fair and enforcorceable. As a result, we can not uphold your request to refund the charges in question and confirm that your complaint has now been closed.

If you are not satisfied ...yada yada"

Where do I go from here. In the charges were also a small amount of PPI that they had put onto the card without my knowledge but will get that back seperatly. Is there anything more I can do??

    Just send another letter saying you are not satisfied with their reply, you will get these charges back.

    Hi Becks92, you have received exactly the same letter as I have in fact, I claimed 605.45 inclusive of interest and PPI. What did they offer me 32.00 and I have to accept within 17 days, I am as stuck as you are, if you get any leads please pass them on to me, perhaps we can fight this one together. PS how did you get back you PPI so easily, then have not mentioned these in their reply to me.

    Hey to both you guys i too claimed back charges from egg card and had exactly the same letter they sent you. they offerd me £32! i refused that straight away, sent
    them another letter refusing there offer and if they did not pay in full i would take my case to the FOS........and wata ya know...a couple days later had another letter from them offering the full amount, just had to accept ,sign and send back to them.

    They took the !!!! deposting the money into my account took nearly 2 weeks but after a firm but freindly phone call to them the money was paid into my account £286 in total!!!

    So all you need to do is stick to your guns refuse any partial payment they offer threaten you will take your case to FOS and watch them shake in there boots cuz they no there not going to win a case when it comes to overlimit credit card charges!

    I have claimed twice from Egg for two different credit cards, received exactly the same letter as you, I wrote back turning their offers down and that I was referring this to the FOS, received replies from them within a few days offering me the full amount. STICK WITH IT! You will get you charges back

    Do you have to pay off the full amount on the card before you can reclaim?

    I don't think so (from a legal standpoint). I'd just prefer to start the fight with a clean slate.

    I have sent both the first and second template letters to Egg and all they have offered me in each is the difference between the £16 cahrge and the earlier £20 charges.

    Earlier in the year I received a total refund of premiums and interest on PPI on the card amounting to just under £2000. If these premiums and interest had never been applied then theoretically, the card would never have gone overlimit and therefore I believe all the overlimit charges are unjustifiable and I intend to write once more to them stating this and see how they react to that.

    Egg also seem to be justifying their £16 charge for all default fees based on the fact that they collect payments by direct debit. I do not see how this can justify an increased charge for over-limit fees over those cc providers who collect payments in other ways. Also unless you are very careful and make additional payments, once overlimit you stay over-limit because they do not adjust the payment amount to correct the situation - very clever on their part
