If item was damaged in post, do I have to return it to seller, and not get postage?

I bought a small item, which arrived today, damaged. I only paid 99p for it. (I know this is irelevant)
I emailed seller, with a photo, and he just said that he will not accept a photo, and for me to get a refund I had to send it back, obviously at my own cost, which would probably cost me 99p anyway!
What are the rules?
I'm new to ebay, so don't know.

Once happened to me with a buyer and I said I'd give them e refund if they sent me a photo of it smashed.0

Thanks, he says he won't accept a photo though, he wants me to send the item back. So I will have paid 99p, then postage, for a damaged item. Then I've got to send it back now, and be without an item, and out of pocket!
Does anyone know what else I can do?
I have had to refund items before, the whole cost, when someone didn't receive it. Seems a bit unfair to me.0 -
Im afraid sellers are not obliged to give return postage costs back, also if you were claiming via paypal then you need to send tracked. Although if I were your seller I would probably give you a refund & ask for copies of the photos to claim via royal mail rather then go through the hassle of returning. I suspect its a tactic to put you off claiming a refund.
As it is a low value item I would write this one off as a bad experience & reflect the customer service received in your feed back.0 -
If you want the seller to refund you, you are required to return the item to the seller at your own cost under ebay rules (unless you come to some other agreement)

I'd be a bit cheesed off that he wouldn't accept a photo.
TBH it's a 99p item, what's your incentive to invent damage?

£1.51 postage (I'm guessing)
So £2.50.
If you send it back, let's say it will cost you 99p to do so
And you will be refunded £2.50
£2.50 refund
-0.99 postage
= £1.51
So you're 99p down. (Feel free to insert your own figures)
I would ask him to confirm that he will be refunding your return costs. If not, then I guess it's up to you whether you'd like the £1.51.
