Samsung Fridge/freezer

Last June we bouught a Samsung fridge/freezer over the internet. On wednesday morning i came downstairs to find that it had broken. An engineer came today and stated that the compressor had gone and it would be a minimum of 4/5 days if part was in stock (in Holland) or longer if it had to come from Korea, phoned samsung to clarify and they said yes that it would be 5 - 28 days for part to turn up. I then asked for a refund or a replacement as having a 7 month old baby we cannot be without at least a fridge for this long. they then stated that it is not their policy to recompence when i asked about this. We are going to be out of pocket to the tune of at least £100.00 (depending on how long it takes to fix) for a table top fridge and jars of baby food (when i had been cooking my own). Can we claim any compensation at all?

Doubtful, Samsung are doing all they can from what you have said. I'd suggest you post a wanted on your local freecycle, I'm sure someone will give you a fridge.
Also, you don't have to buy jars of baby food. I managed quite well with 2 kids and never bought a jar. I cooked fresh for them daily, much cheaper and healthier without all the added salt.0 -
i have posted on freecyle (the day the appliance went down) and to date have had no replies and i do actually cook my own baby food but i batch cook (because it is easier for me) due to all the running round to school and clubs after my other kids, which means i have to freeze, and do you honestly think you could go 28 days without a fridge/freezer0

Contact the supplier, not the manafacturer. They must repair within a reasonable time, or replace/refund.

Honestly? Yes! Its inconvenient I will admit, but it's possible. They managed without them years ago.0 -
Was the fridge freezer new when bought if itw as you may have a chance of claiming under sale of goods act. You say the compressor has gone thats a major part so it its new then when bought in June last year you may have a claim but you need to ask for prove
When you say compensation if it was new then all you can get is a repair under sale of goods act or if not a partial refund
If food was off you may be able to claim that0 -

thanks i have done that but it is out of the year guarantee but is within the 2 year guarantee that samsung give but the supplier does not0 -
You should be able to claim under SOGA as a compressor should last over a year
Get the guy back and get him to put it in writing that should be proof that it has an inherent fault0 -

Yes it was new (in fact according to Samsungs records (due to the serial no) the appliance was only manufactured in April 2008.. I actually lost almost £200 worth of food having paid a recent visit to a farmers market and had the weekly grocery shop delivered the day before and 2 weeks worth of cooked baby food which before anyone asks is covered by contents insurance but we have a £200 excess on having checked the policy0 -
Here is the sale of goods act
I would say that the sale of goods act applies here you would reasonable expect a fridge freezer to last at least 5-6 years if not more

• In general, the onus is on all purchasers to prove the goods did not conform to contract (e.g. was inherently faulty) and should have reasonably lasted until this point in time (i.e. perishable goods do not last for six years).
Q1. What is an inherent fault?
A fault present at the time of purchase. Examples are:
• an error in design so that a product is manufactured incorrectly
• an error in manufacturing where a faulty component was inserted.
The "fault" may not become apparent immediately but it was there at the time of sale and so the product was not of satisfactory standard.0 -

Guarantees are largely irrelevant. The item must last for a reasonable period of time (effectively depends upon the price paid) and your contract is with the supplier not the manufacturer. Clearly the fridge/ freezer should have lasted two years as Samsung are willing to guarantee this and the shop presumably advertised the item as such.
