CEX - problems with a return

I purchased a Blackberry from them yesterday of which I have noticed a fault with the loudspeaker, it is clearly faulty, however sometimes if you shake the phone it fixes itself but however I'm not happy with it.
I went in today, and the lady tested it, and it did indeed sound fine, but as soon as I adjusted the volume I could hear the fault again, by the time I passed the phone back for her to hear. The o2 lady voice recording had stopped speaking and she just hung up and said theres no fault, and said they can't take the phone back.
After telling them its a bit intermittent they didn't believe me, so they said they would book it in for a test and I can go back later today to see if they found any fault.
My question is are they allowed to do this? Can they make me keep a phone that I'm not happy with as its faulty. I wouldn't mind getting an exchange on the same phone or even another phone.
Under the Sales of Goods Act is there anything to help me as I really don't want to keep a faulty phone!
I would appreciate any help from you guys.
