After months of anging my head against a brick wall with Tisacli billing , I am about to break contact and get Bt to takeover the line. I'm sure the documentary proof of Tiscali errors in billing would mean no judge in the country would grant a order for the fees they will try and levy ( rest of contract / cancellation charges) .. just wondered however if anyone knows whether Tiscali are able to record non payment in a credit file ( like mobile phones do) rtaher than court action.

Do not walk away from money you owe.

Demand they put their errors right and give a correct bill within 14 days, or you will have to close the account before term without penalty. Do this in writing and itemise the errors so far, stating the problems it is causing you. Keep a copy. Only then are you defensible in court.

After that, if they are still in error, offer to pay what you think you owe in full and final settlement and dispute the cancellation charges.

You need to have a strong disposition to carry it off.

done all of this , and more .. keen not to walk away , but to get an agreement to terminate, but if I had to...

I've no problem with courts , but its if they can register a default on credit file without going to court ?

I believe they can (register you as being in default) without bothering to take you to court. In fact, hardly any of the telcos or mobile firms will bother taking you to court unless thedebt is substantial. By blighting your credit file, they get to mess with your life, sell on the debt and move on. Leaving you to sort the mess or suffer it for 6 years.

You'll need to check your Terms of Service to see if they disclose. BT do not (as yet) but I believe Talk Talk and Tiscali do.

Now that Talk Talk have taken over Tiscali how about trying an email to their CEO. Sometimes does the trick.
