    I'm waiting to go BR after my IVA failing.....am waiting for Breach notice to be sent to me...then aply have to answer that in writing to confirm I want y IVA terminated and reason why [ payments no longer sustainable ]....then notice is sent to my creditors informing them and they are given option of petitoning for my BR or refusing to allow IVA to be terminated [ aptly refusal is not an issue as I now have no surplus income to pay IVA ]......creditors have to be given 28 days to reply to this....then I will recieve a Termination Certificate to present with my BR forms.....my IVA was with CCCSVA.

    Is this what you had to do?

    yup, i had my certificate of non completion which is why i was confused at this 2 week period to contact nominees.... disappointment is wearing off a little and at least we can be happy in the fact that the fees are paid and theres no more worries about raising them!

    Oh No....have you discovered why you have to wait 2 weeks? I have been lead to believe that as long as I had Termination Certificate that part would be straight forward.

    Has anyone any experience of going BR after failing IVA?

    yep ii had iva which failed. I went BR last week and iva failed week before. When I handed in the forms I was told by the clerk it may be a problem depending on the judge but the judge i saw passed the petiition my certificate of non compliance with the iva did state h0wever that i would be petioning my bankruptcy as i advised my iva company inn advance.
