David Wilson Homes/ Barratt Homes

I posted about this long ago, but it will be clearer if I start a new thread!
Quick summary:
* Three years ago I bought a David Wilson Home (DWH)
* I discovered within the first few months that the sink was faulty
* David Wilson agreed to replace the sink, both to myself and to Zurich (equivalent to NHBC)
* David Wilson cancelled or failed to turn up for at least four appointments
* I still have a faulty sink!
I have been poorly so unable to chase things up over the past year, however approx five weeks ago I wrote to David Wilson explaining that all trust had broken down between myself and DWH, and therefore I would like them to offer me a suitable amount to get a new sink installed. I did not ask for compensation or any unrealistic amount, just sufficient to cover my costs.
The initial reply from DWH stated that I had never reported this problem to them. I replied promptly, enclosing copies of correspondance from DWH stating that the sink would be replaced!
I eventually received a reply from this, with no apology, but an offer for them to replace the sink. I replied by return of post, reiterating what I had stated in my first letter, that due to my previous experience I did not think that this was a suitable conclusion.
Roll on two weeks and I have now received another letter from DWH, offering to replace my sink (do they even read my letters?)!
So today I am going to call them to discuss why they are ignoring my requests, and if no joy I will issue small claims proceedings. I would hope that a District Judge would understand how many times I have been let down by DWH, and hence agree to my request for payment from DWH.
Will update later!

Thank you!
I have called them, asked if the Customer Services Manager was available, and told yes. The receptionist then asked my name and went to put me through ... and suddenly he became unavailable! :rolleyes:Gone ... or have I?0 -

What a twonk!
When responsible for switchboard I always found it preferable to establish who was calling first before deciding whether my boss was 'in' or not!
:rotfl:
I hope you get it sorted out, I think your request is more than reasonable considering how long this has been going on and how they have let you down previously.0 -
Not sure if you're aware but there's no statutory protection for buyers of new homes - the interpretation of the word 'goods' in SoGA is 'personal property of a moveable type', so a court might well say the home was 'sold as seen' - caveat emptor.0
