faulty shoes

Options
My daughter bought a pair of shoes from a store, on wearing them once the coating on the shoes started to peel. She took them back to the store for a refund, and was told a credit nore was the best she could expect. I work in electrical retail, and my understanding of the law, is that if goods are faulty, a refund is available, despite the obligatory "we don't do refunds" sign by the till. Company Policy does not usurp the sale of goods act. The storeis not a discount store, the shoes cost £18, not seconds or outlet. I thought I knew where i stood, but on closer inspection, i'm beginning to doubt myself! I have been in retail for over 20 years! My daughter is 12, and i feel she's being fobbed off. Help....lol!

    you thought rights

march in with her and declare that you are rejecting the goods under the the sale of goods act section 14 as they are faulty and that it is your statutory right to a refund in this case

if they refise ask for people higher up and do not leave.

if you get nowhere tell them trading standards should be in touch

In my opinion a 12 year old should not have been given the responsibility of returning them anyway, had you taken them yourself the first time they would probably have refunded first time and you would not have had all this hassle.
make the most of it, we are only here for the weekend.
and we will never, ever return.

    a bit harsh

if a 12 year old is capable of buying then they should also learn returning, ok so a parent would have helped for support but they have to learn at some point

or else in the future they will be on here asking something else

  • The sign by the till applies to arbitrary refunds when you simply decide you don't like the colour of the item for example - accepting a return in that case is a gesture of good will. That's why it always says 'Does not affect your statutory rights', meaning that where the goods are faulty - as is clearly the case with your daughter's shoes - you have the right to return them and ask for a refund or a repair (under s14 Sale of Goods Act, as stated above). Definitely go get your refund! If it doesn't work in store ask for the store manager's name and the address for head office and write a letter, that should work.

it doesnt always have that i came across one the other week just saying no refunds in a small local electricals shop

    thats it

i asked and they said in the case of faults they replace or credit note

i pointed out that this was wrong and they are committing an offence by denying consumers rights and that if they dint remove it i shall contact trading standards

the owner promptly removed it and i obviously reported it anyways

just shows not every store is so honest.

Just to clarify...my mother in law took them back for a refund..not my daughter. My apologies for not making that clear
